FLEAP FLAPP MARKETPLACE TERMS AND CONDITIONS

These Terms govern your access to and use of FLEAP FLAPP Marketplace and its related websites, mobile applications, listings, purchasing tools, seller tools, live-commerce features, communications, payment features, and other services we make available.By registering for, accessing, or using FLEAP FLAPP Marketplace, you acknowledge that you have read, understood, and agreed to these Terms.If you do not agree to these Terms, you must not access or use FLEAP FLAPP Marketplace.
1. Eligibility
FLEAP FLAPP Marketplace is intended only for individuals who are at least 18 years old.By accessing or using Marketplace features, you represent and warrant that:- You are at least 18 years old.
- You have the legal capacity to enter into a binding agreement.
- You are legally permitted to use the Marketplace in your country, state, territory, or region.
- You are not prohibited from using the Marketplace under applicable law.
- You have not previously been permanently banned from FLEAP FLAPP unless we have provided written authorization for your return.
2. Agreement to FLEAP FLAPP Policies
These Marketplace Terms incorporate the following policies by reference:- FLEAP FLAPP Terms of Service.
- FLEAP FLAPP Privacy Policy.
- FLEAP FLAPP Community Guidelines.
- FLEAP FLAPP Marketplace Community Guidelines.
- FLEAP FLAPP Marketplace Seller Policy.
- FLEAP FLAPP Trust and Safety information.
- FLEAP FLAPP Copyright and Intellectual Property Policy.
- Any additional rules, disclosures, or feature-specific terms presented to you.
3. User accounts
You may be required to create and maintain a FLEAP FLAPP account to access Marketplace features.You agree to:- Provide accurate, truthful, complete, and current information.
- Maintain only accounts you are legally authorized to use.
- Keep your password and verification information confidential.
- Protect your devices and account access.
- Notify us promptly if you suspect unauthorized access.
- Update your account information when it changes.
- Complete reasonable security or verification requirements when requested.
- Create a false or misleading account.
- Impersonate another person, seller, creator, business, or organization.
- Use an identity, payment method, or business registration without authorization.
- Sell, transfer, rent, or share your account.
- Create additional accounts to evade a warning, restriction, suspension, or permanent ban.
- Use automated methods to create or control accounts without authorization.
4. Marketplace’s role
FLEAP FLAPP Marketplace provides technology that may allow independent buyers, sellers, creators, and businesses to discover, communicate, list, promote, purchase, or sell products and services.Unless expressly stated otherwise, FLEAP FLAPP:- Is not the seller of products listed by independent sellers.
- Does not manufacture, own, possess, inspect, store, or ship products offered by independent sellers.
- Does not guarantee that a buyer or seller will complete a transaction.
- Does not guarantee the accuracy, legality, safety, quality, authenticity, or availability of a listing.
- Does not endorse a seller, buyer, product, service, listing, review, or transaction merely because it appears on the platform.
- Is not a party to agreements made directly between independent buyers and sellers, except when expressly stated.
- Is not responsible for statements or promises independently made by Marketplace users.
5. Availability of Marketplace services
Marketplace services and features may vary according to:- Country, state, territory, or region.
- Account status and eligibility.
- Identity or business verification.
- Product category.
- Platform or application version.
- Payment-provider availability.
- Shipping availability.
- Applicable law.
- Security or risk considerations.
6. Seller eligibility and verification
Before listing or selling products or services, sellers may be required to provide information such as:- Legal name.
- Date of birth.
- Physical or business address.
- Telephone number and email address.
- Government-issued identification.
- Business-registration information.
- Tax-identification information.
- Banking or payout information.
- Information concerning products, suppliers, or business activities.
- Other information reasonably required for security, payment processing, fraud prevention, or legal compliance.
7. Seller responsibilities
Sellers are responsible for their accounts, listings, products, services, customer communications, fulfillment, shipping, taxes, returns, refunds, regulatory compliance, and after-sale support.Sellers must:- Provide truthful, accurate, complete, and non-misleading listings.
- Use photographs and videos that fairly represent the offered product or service.
- Accurately describe the product’s condition, quantity, size, origin, brand, features, limitations, and availability.
- Clearly disclose the complete price and any applicable seller-imposed charges.
- Clearly explain shipping, delivery, processing, return, cancellation, and refund terms.
- Deliver products or provide services as described.
- Maintain sufficient inventory before representing that a product is available.
- Respond to legitimate buyer concerns professionally and in good faith.
- Comply with product-safety, labeling, licensing, advertising, consumer-protection, export, import, sanctions, shipping, tax, and other applicable requirements.
- Obtain all rights and permissions necessary to sell or promote their products.
- Protect buyer information and use it only for legitimate transaction-related purposes.
- Maintain appropriate records concerning listings, orders, shipping, returns, taxes, and customer communications.
- Cooperate with legitimate safety, fraud, payment, transaction, or legal reviews.
8. Buyer responsibilities
Buyers must:- Provide accurate account, order, delivery, and payment information.
- Review listing descriptions and seller terms before purchasing.
- Use only payment methods they are authorized to use.
- Communicate respectfully and honestly.
- Maintain accurate delivery information.
- Inspect delivered products within a reasonable period.
- Report genuine problems accurately and promptly.
- Provide relevant information or evidence when requested.
- Use refunds, disputes, and chargebacks only for legitimate reasons.
- Comply with applicable laws and FLEAP FLAPP policies.
- Make fraudulent or unauthorized purchases.
- Use stolen payment information.
- Submit false item-not-received or product-condition claims.
- Falsely claim that a transaction was unauthorized.
- Abuse refunds, payment disputes, or chargebacks.
- Threaten or pressure a seller to obtain free products, refunds, discounts, or benefits.
- Manipulate Marketplace reviews or transaction records.
- Purchase prohibited products.
- Use Marketplace purchases for unlawful purposes.
9. Prohibited and restricted products
You may not list, promote, purchase, sell, distribute, or facilitate products or services that violate applicable law or FLEAP FLAPP policies.Prohibited or restricted categories may include:- Illegal or stolen goods.
- Counterfeit, pirated, or unauthorized products.
- Weapons and products primarily intended to cause harm.
- Explosives, hazardous materials, and dangerous chemicals.
- Controlled substances and illegal drugs.
- Prescription drugs or regulated medical products offered without authorization.
- Fraudulent products, documents, credentials, or services.
- Human-trafficking-related products, services, or content.
- Animal trafficking or illegal wildlife products.
- Sexually exploitative products or services.
- Child sexual abuse or exploitation material.
- Products that violate intellectual-property rights.
- Recalled, unsafe, defective, or materially misrepresented products.
- Products or services involving discrimination, harassment, or hate.
- Financial scams, pyramid schemes, or deceptive investment opportunities.
- Products or services prohibited by payment providers.
- Products or services creating an unreasonable safety, fraud, or legal risk.
10. Accurate listings and advertising
Listing titles, descriptions, photographs, videos, prices, categories, keywords, availability, product condition, shipping terms, and promotional statements must be accurate.You may not:- Conceal material defects, damage, fees, recurring charges, limitations, or safety concerns.
- Advertise one price and demand a different price later.
- Create false scarcity or urgency.
- Misrepresent a product’s brand, origin, authenticity, condition, size, quantity, or features.
- Use unrelated, stolen, or materially altered photographs to misrepresent a product.
- Make deceptive medical, financial, performance, environmental, or safety claims.
- Promise products, services, or results that cannot reasonably be delivered.
- Use misleading categories, tags, or keywords to manipulate discovery.
- Publish sponsored or paid promotional content without disclosures required by law.
11. Marketplace live streaming
Eligible users may use Marketplace live-streaming features to present products, demonstrate services, communicate with viewers, and promote legitimate commercial activity.Marketplace live streams must comply with these Terms and all FLEAP FLAPP Community Guidelines.Live streams may not contain:- Sexual activity or prohibited nudity.
- Harassment, threats, bullying, or hate speech.
- Illegal products or activities.
- Scams, fraudulent giveaways, or deceptive selling techniques.
- Dangerous conduct or challenges.
- Exploitation or trafficking-related content.
- Copyrighted music, video, images, or other content used without authorization.
- Misleading product demonstrations.
- Pressure to use unsafe or unauthorized payment methods.
12. Orders and contracts between users
A purchase order may constitute an offer by the buyer to purchase the listed product or service. A transaction may be confirmed, rejected, canceled, or reviewed depending on the applicable checkout process, product availability, payment authorization, fraud review, seller acceptance, and applicable law.Sellers must not accept orders they cannot reasonably fulfill.FLEAP FLAPP may cancel or restrict an order where permitted when:- A product is prohibited.
- The listing or price is materially incorrect.
- Fraud or unauthorized payment is suspected.
- A security or legal concern exists.
- The transaction violates these Terms.
- A payment provider rejects or reverses the transaction.
- Completion of the transaction is not reasonably possible.
13. Payments
Where payment features are available, payments may be processed by authorized third-party payment providers.By submitting payment information, you represent that:- The information is accurate.
- You are authorized to use the payment method.
- You authorize the applicable charges.
- You will pay all valid charges associated with your transaction.
- Fraud prevention.
- Payment security.
- Unauthorized-activity prevention.
- Risk management.
- Policy enforcement.
- Payment disputes.
- Sanctions screening.
- Legal or regulatory compliance.
14. Fees
FLEAP FLAPP may charge fees for eligible services or features, including:- Listing services.
- Completed transactions.
- Seller services.
- Payment processing.
- Payout processing.
- Advertising or promotional tools.
- Subscriptions or premium features.
- Other optional services.
15. Seller payouts and reserves
If seller-payout features become available, sellers may be required to establish an eligible payout account and complete verification.FLEAP FLAPP or its payment providers may delay, hold, offset, restrict, or reverse funds where permitted when:- Fraud or suspicious activity is detected.
- A transaction is disputed.
- A chargeback occurs.
- A refund may be required.
- A seller has unfulfilled orders.
- Verification is incomplete.
- A policy violation or legal concern exists.
- A negative balance is present.
- A payment provider requires the action.
16. Taxes
Sellers are responsible for identifying, collecting, reporting, and paying taxes, duties, fees, assessments, or other governmental charges associated with their Marketplace activities, except where FLEAP FLAPP or a service provider is legally required to perform those functions.FLEAP FLAPP may:- Request tax information.
- Report Marketplace activity to tax authorities when required.
- Withhold amounts when legally required.
- Calculate, collect, or remit certain taxes when required or supported.
- Provide transaction information for tax purposes.
17. Shipping, delivery, and fulfillment
Sellers are responsible for accurately describing their processing and shipping terms and fulfilling orders within the promised timeframe.Sellers must:- Use accurate delivery addresses supplied through authorized Marketplace processes.
- Package products appropriately.
- Comply with carrier and legal restrictions.
- Provide accurate shipment or tracking information when available.
- Avoid falsely marking an order as shipped or delivered.
- Communicate material delays promptly.
- Preserve shipping and delivery records.
18. Returns, refunds, and cancellations
Sellers must clearly disclose their return, refund, and cancellation terms, subject to applicable law and FLEAP FLAPP policies.Buyers are responsible for reviewing those terms before purchasing.The availability and outcome of a return, refund, cancellation, dispute, or purchase-protection request may depend on:- Applicable law.
- The seller’s disclosed policy.
- The payment provider’s rules.
- The product or service involved.
- The transaction circumstances.
- Available supporting evidence.
- The Marketplace features available in the user’s region.
19. Chargebacks and payment disputes
Users must attempt to resolve legitimate transaction issues using available seller, payment-provider, or Marketplace support processes when reasonable.A chargeback or payment dispute must not be used fraudulently or as a substitute for communicating a legitimate concern.FLEAP FLAPP may provide transaction information to payment providers and may restrict accounts connected to:- Fraudulent chargebacks.
- Repeated payment disputes.
- False unauthorized-transaction claims.
- Abuse of refund systems.
- Unpaid balances.
- Suspicious payment activity.
20. Ratings and reviews
Ratings and reviews must reflect genuine experiences and comply with applicable law.Users may not:- Buy, sell, trade, or manufacture fake reviews.
- Review their own products through another account.
- Offer compensation for deceptive reviews.
- Require a positive review as a condition of support.
- Threaten another person over a review.
- Organize coordinated review attacks.
- Use automated systems or fake accounts to manipulate ratings.
- Post unlawful, harassing, irrelevant, or knowingly false content.
21. User content and licenses
You retain ownership of content you create and upload, subject to the rights of others and the licenses granted in these Terms.By submitting listings, photographs, videos, live streams, reviews, messages intended for public display, business information, or other Marketplace content, you grant FLEAP FLAPP a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to:- Host, store, reproduce, process, format, adapt, translate, display, distribute, and make the content available.
- Operate, secure, moderate, improve, and promote FLEAP FLAPP.
- Display listings and related content across FLEAP FLAPP services.
- Create technical modifications necessary for different devices, formats, and networks.
- Use Marketplace content in connection with platform discovery and authorized promotion.
22. Intellectual property
The FLEAP FLAPP name, logos, trademarks, designs, software, interfaces, databases, text, graphics, platform organization, and other proprietary materials belong to FLEAP FLAPP LLC or its licensors.Except as expressly permitted, you may not:- Copy, reproduce, modify, distribute, sell, license, or exploit FLEAP FLAPP intellectual property.
- Use FLEAP FLAPP branding in a misleading manner.
- Suggest an affiliation, endorsement, or partnership that does not exist.
- Reverse engineer, decompile, or attempt to extract source code except where such restriction is prohibited by law.
- Remove copyright, trademark, or proprietary notices.
- Register names, domains, accounts, or marks confusingly similar to FLEAP FLAPP.
23. Intellectual-property complaints
Users may not list or distribute content or products that violate copyright, trademark, patent, publicity, or other proprietary rights.A rights holder or authorized representative may submit a complaint to:support.team@fleapflapp.comA complaint should include sufficient information to identify:- The protected work, mark, or right.
- The allegedly infringing listing or content.
- The complainant and their authority to submit the complaint.
- Contact information.
- A good-faith explanation of the alleged violation.
- Any legally required statements or signature.
24. Privacy and personal information
FLEAP FLAPP’s collection, use, disclosure, retention, and protection of personal information are described in the FLEAP FLAPP Privacy Policy.Marketplace users may receive limited information about another user when reasonably necessary to complete a transaction, comply with law, prevent fraud, or resolve a dispute.You may use another person’s information only for authorized Marketplace purposes. You may not:- Sell or distribute another person’s information.
- Use buyer or seller information for unrelated marketing without required permission.
- Harass, discriminate against, threaten, or stalk another person.
- Publish private information without authorization.
- Use Marketplace information for fraud, identity theft, or other harmful activity.
25. Security and fraud prevention
You agree that FLEAP FLAPP may use reasonable security and fraud-prevention measures, including:- Email or account verification.
- CAPTCHA or similar protections.
- Payment-attempt limits and temporary restrictions.
- Identity or business verification.
- Trust or risk indicators.
- IP-address and device information.
- Transaction monitoring.
- Suspicious-activity alerts.
- Administrative review of flagged activity.
- Account, feature, or device restrictions.
26. Prohibited platform conduct
You may not:- Violate applicable law or another person’s rights.
- Commit or facilitate fraud, scams, money laundering, sanctions evasion, or identity theft.
- Harass, threaten, stalk, intimidate, or dox another person.
- Upload malware or harmful code.
- Hack, probe, disrupt, overload, or interfere with the platform.
- Access accounts, systems, or information without authorization.
- Scrape, crawl, harvest, or extract platform data without written authorization.
- Use bots or automated tools without permission.
- Manipulate search, recommendations, engagement, reviews, or Marketplace activity.
- Circumvent payment, safety, verification, or enforcement systems.
- Reverse engineer the Marketplace except where applicable law expressly permits it.
- Use FLEAP FLAPP to build or train a competing service without written authorization.
- Resell access to Marketplace services.
- Encourage or assist another person in violating these Terms.
27. Enforcement
When FLEAP FLAPP reasonably believes that a violation, safety concern, fraud risk, legal requirement, or security issue exists, we may:- Issue a warning.
- Remove or restrict content or listings.
- Reduce content visibility.
- End a live stream.
- Remove a live-stream recording.
- Cancel or reverse a transaction where permitted.
- Hold or delay funds where permitted.
- Require additional verification.
- Restrict selling, buying, messaging, advertising, live streaming, or monetization.
- Suspend Marketplace access.
- Suspend the entire FLEAP FLAPP account.
- Permanently terminate an account or block a device.
- Preserve relevant information for an investigation.
- Report serious conduct to payment providers, regulators, law enforcement, or other appropriate authorities where required or permitted.
28. Appeals
Users may appeal an eligible enforcement decision by contacting:safety@fleapflapp.comAppeals should generally be submitted within fourteen (14) days after the enforcement action and should include:- The user’s full name and username.
- The affected account, listing, transaction, live stream, or feature.
- The date of the decision.
- An explanation of why the user believes the decision was incorrect.
- Relevant supporting information or evidence.
29. Account suspension, termination, and deletion
You may stop using the Marketplace at any time. Account-deletion requests may be submitted through available account settings or support channels.FLEAP FLAPP may restrict, suspend, or terminate access when you:- Violate these Terms or another FLEAP FLAPP policy.
- Violate applicable law.
- Engage in fraud, abuse, deception, or harmful conduct.
- Create an unacceptable security, payment, or legal risk.
- Fail required verification.
- Accumulate unpaid amounts or a negative balance.
- Harm Marketplace integrity or other users.
- Attempt to evade an earlier enforcement action.
30. Third-party services
Marketplace features may rely on independent payment processors, cloud providers, analytics providers, advertising services, shipping carriers, verification providers, communication services, application stores, or other third parties.Third-party services may have their own terms and privacy policies.To the extent permitted by law, FLEAP FLAPP is not responsible for:- A third party’s independent acts or omissions.
- A third party’s service interruption.
- A carrier’s loss, damage, or delay.
- A payment provider’s independent decision.
- External websites or services.
- Products or services offered independently by third parties.
31. Disclaimers
TO THE MAXIMUM EXTENT PERMITTED BY LAW, FLEAP FLAPP MARKETPLACE IS PROVIDED “AS IS” AND “AS AVAILABLE.”FLEAP FLAPP DISCLAIMS WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, AND ANY WARRANTIES ARISING FROM COURSE OF DEALING OR USAGE OF TRADE, EXCEPT WHERE SUCH WARRANTIES CANNOT LEGALLY BE DISCLAIMED.FLEAP FLAPP DOES NOT WARRANT THAT:- THE MARKETPLACE WILL ALWAYS BE AVAILABLE, SECURE, ACCURATE, OR ERROR-FREE.
- LISTINGS OR USER CONTENT WILL BE ACCURATE.
- USERS WILL COMPLETE TRANSACTIONS.
- PRODUCTS OR SERVICES WILL MEET EXPECTATIONS.
- SELLERS OR BUYERS WILL COMPLY WITH THE LAW OR THESE TERMS.
- ALL FRAUD, HARMFUL CONTENT, OR UNAUTHORIZED ACTIVITY WILL BE DETECTED.
- DATA WILL NEVER BE LOST.
- DEFECTS OR INTERRUPTIONS WILL ALWAYS BE CORRECTED.
32. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, FLEAP FLAPP LLC AND ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, CONTRACTORS, LICENSORS, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, LOST REVENUE, LOST BUSINESS, LOST DATA, LOSS OF GOODWILL, OR SUBSTITUTE SERVICES ARISING FROM OR RELATED TO THE MARKETPLACE.TO THE MAXIMUM EXTENT PERMITTED BY LAW, FLEAP FLAPP IS NOT LIABLE FOR:- USER-GENERATED CONTENT.
- INDEPENDENT BUYERS, SELLERS, OR OTHER USERS.
- MARKETPLACE DISPUTES.
- COUNTERFEIT, UNSAFE, DEFECTIVE, OR ILLEGAL PRODUCTS.
- THIRD-PARTY SERVICES.
- SHIPPING LOSS OR DELAY.
- UNAUTHORIZED ACCESS CAUSED BY A USER’S FAILURE TO PROTECT THEIR ACCOUNT.
- INTERRUPTIONS, ERRORS, OR DATA LOSS.
- ACTIONS TAKEN REASONABLY TO ENFORCE THESE TERMS OR COMPLY WITH LAW.
- $100 USD; OR
- THE TOTAL AMOUNT YOU PAID DIRECTLY TO FLEAP FLAPP FOR THE MARKETPLACE DURING THE SIX MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM.
33. Indemnification
To the extent permitted by law, you agree to defend, indemnify, and hold harmless FLEAP FLAPP LLC and its affiliates, officers, directors, employees, contractors, licensors, and service providers from claims, losses, liabilities, damages, judgments, penalties, costs, and reasonable legal fees arising from or related to:- Your listings, products, services, or content.
- Your violation of these Terms.
- Your violation of applicable law.
- Your infringement of another person’s rights.
- Your taxes, shipping, fulfillment, refunds, or customer obligations.
- Your fraud, negligence, willful misconduct, or misuse of the Marketplace.
34. Governing law and dispute resolution
Before initiating formal legal proceedings, you and FLEAP FLAPP agree to make a good-faith effort to resolve the dispute informally.A written notice of dispute should contain:- The name and contact information of the complaining party.
- The applicable username or account.
- A description of the dispute.
- The requested resolution.
- Relevant supporting information.
- Seeking emergency or temporary injunctive relief.
- Reporting conduct to a government authority.
- Cooperating with law enforcement or regulators.
- Exercising rights that cannot legally be waived.
- Filing a claim in another forum when applicable consumer law requires it.
35. Changes to these Terms
FLEAP FLAPP may update these Terms to reflect changes in:- Marketplace features.
- Business operations.
- Security practices.
- Payment or service providers.
- Applicable laws or regulatory requirements.
- Safety and enforcement standards.
36. Electronic communications
By using the Marketplace, you consent to receive notices and communications electronically, including through:- Email.
- In-app messages.
- Account notifications.
- Website postings.
- Other electronic methods associated with your account.
