Last Updated: 30 Sep 2025 Welcome to FLEAP FLAPP Marketplace (“Marketplace,” “we,” “us,” “our”). These Terms & Conditions (“Terms”) govern your access to and use of the Marketplace and any services, features, or tools we provide. By registering, accessing, or using the Marketplace, you agree to these Terms in full. If you do not agree, do not use the platform.

1) Acceptance of Terms

By creating an account or using the Marketplace, you confirm that you:
  1. Are at least 18 years old (or meet your local age of majority) or have verifiable parental/guardian consent if under that age.
  2. Have read, understood, and agree to these Terms, our Privacy Policy, and any additional policies posted on the platform.
  3. Will comply with all applicable local, national, and international laws.

2) User Accounts

  1. You are responsible for keeping your login credentials secure and confidential.
  2. You are liable for all activity under your account, including unauthorized use.
  3. Notify us promptly of any suspected unauthorized access or security issue.

3) Marketplace Services

The Marketplace is a platform where independent sellers and buyers connect and complete transactions. We do not:
  1. Own, manufacture, or sell items listed by sellers;
  2. Guarantee the accuracy, legality, or quality of listings;
  3. Assume responsibility for transactions between users.

4) Seller Responsibilities

Sellers must:
  1. Ensure listings are accurate, truthful, and not misleading;
  2. Clearly state prices, shipping terms, refund/return policies, and delivery timelines;
  3. Comply with laws (tax, licenses, product safety, labeling, advertising);
  4. Provide prompt, professional communication and post-sale support.

5) Buyer Responsibilities

Buyers must:
  1. Provide accurate order and payment information;
  2. Pay using approved payment methods;
  3. Review seller refund/return policies before purchasing;
  4. Use the official Marketplace dispute process for issues.

6) Prohibited Activities

You agree not to:
  1. Post, sell, promote, or facilitate illegal, counterfeit, stolen, unsafe, or otherwise prohibited items;
  2. Upload harmful, offensive, deceptive, or misleading content;
  3. Commit or facilitate fraud, scams, abuse, harassment, doxxing, or threats;
  4. Infringe intellectual property, privacy, or other third-party rights;
  5. Interfere with the platform (e.g., hacking, scraping, reverse engineering).
Violations may result in removal of content, listing restrictions, suspension, or permanent account termination.

7) Payments & Fees

  1. We may charge service, listing, transaction, payout, or promotional fees.
  2. Fees will be disclosed before you use a paid service or feature.
  3. You authorize us and our payment partners to process payments securely.

8) Refunds & Returns

  1. Each seller sets their own refund/return policy (subject to applicable law and our rules).
  2. Buyers must review the seller’s policy before purchasing.
  3. We may facilitate communication in disputes but do not guarantee refunds or returns.

9) Suspension or Termination

We may suspend, restrict, or terminate accounts (with or without notice) if you:
  1. Violate these Terms, our policies, or applicable laws;
  2. Engage in fraud, abuse, or harmful conduct;
  3. Harm the integrity, security, or reputation of the Marketplace.

10) Intellectual Property

  1. FLEAP FLAPP names, logos, designs, software, and platform content are our property or licensed to us. You may not copy, modify, distribute, or exploit them without written permission.
  2. Users retain rights to their own content, but grant us a non-exclusive, royalty-free, worldwide license to host, store, display, distribute, and promote listings within the Marketplace and in connection with operating/promoting the service.

11) Limitation of Liability

To the maximum extent permitted by law:
  1. We are not liable for direct, indirect, incidental, special, consequential, or punitive damages arising from your use of (or inability to use) the Marketplace;
  2. We are not responsible for user-generated content, third-party services, disputes between users, lost profits, data loss, or service interruptions;
  3. You use the platform at your own risk.

12) Modifications

We may update these Terms at any time. We will post the revised version with a new “Last Updated” date. Your continued use of the Marketplace means you accept the updated Terms.

13) Governing Law & Dispute Resolution

  1. These Terms are governed by the laws of the State of Maryland, USA, without regard to conflict-of-law rules.
  2. Disputes should first go through our internal resolution process. If unresolved, they may proceed to binding arbitration or small-claims court, as allowed by law. You and we waive class actions to the extent permitted by law.
